These Terms of Service (“Terms”) govern access to and use of The Jackpot Guide website, mobile application, software, tools, content, and related services (collectively, the “Service”), operated by The Jackpot Guide, LLC (“The Jackpot Guide,” “we,” “our,” or “us”). By accessing or using the Service, creating an account, purchasing a subscription or add-on, or submitting content, you agree to these Terms. If you do not agree, do not access or use the Service.
1. Acceptance and incorporated policies
These Terms form a binding agreement between you and The Jackpot Guide. The Privacy Policy, Automatic Renewal and Subscription Terms, SMS Terms and Conditions, and DMCA Copyright Policy are incorporated into these Terms by reference and apply when relevant to your use of the Service.
If a conflict exists between these Terms and the Automatic Renewal and Subscription Terms concerning a subscription, trial, renewal, cancellation, refund, or price change, the Automatic Renewal and Subscription Terms control as to that subject.
2. Eligibility and accounts
You must be at least thirteen (13) years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the permission and supervision of a parent or legal guardian. You must be at least eighteen (18) years old, or the age of majority in your jurisdiction, to create a producer account, purchase a producer subscription or paid add-on, or enroll in SMS messaging.
By creating a general user account, you confirm that you are at least thirteen (13) years old. Before creating, claiming, or controlling a producer profile, purchasing a producer subscription or paid add-on, or otherwise acting for a producer or business, you must separately confirm that you are at least eighteen (18) years old, or the age of majority where you live, and that you are authorized to act for that producer or business.
You agree to provide accurate, complete, and current information and to update it when necessary. You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring through your account. You must notify us promptly if you believe your account has been accessed or used without authorization.
You may not sell, transfer, share, or permit another person to use your account in a manner that violates these Terms or creates a security risk.
3. Description of the Service
The Jackpot Guide is a discovery and listing platform that helps users locate rodeo, equine, jackpot, and related events across multiple disciplines and provides producers with tools to create, manage, publish, and promote event listings.
The Jackpot Guide is not the organizer, producer, promoter, sanctioning body, registration service, entry processor, insurer, or operator of any event unless we expressly state otherwise in writing. Event entries, fees, eligibility decisions, payouts, refunds, waivers, and participation arrangements occur directly between users and the applicable producer or organizer.
4. Event information and platform role
Event information is supplied primarily by producers and other third parties. Although we may use automated tools or reasonable review procedures to format, organize, or identify apparent errors, we do not independently verify every listing.
Before traveling, entering, paying fees, transporting animals, or participating, you must confirm all material details directly with the producer, including dates, times, location, directions, entry requirements, fees, divisions, numbering, livestock requirements, rules, payouts, cancellations, refunds, weather conditions, and safety procedures.
Display, promotion, featuring, or advertising of an event does not constitute an endorsement, certification, inspection, guarantee, or recommendation by The Jackpot Guide.
5. Producer obligations and listings
If you create or manage a producer profile or listing, you represent and warrant that you are authorized to act for the producer or event and that all information you provide is accurate, lawful, current, and not misleading.
Producers are solely responsible for:
- The organization, operation, safety, supervision, insurance, legality, and financial administration of their events.
- Entry rules, eligibility, livestock and equipment requirements, prizes, payouts, cancellations, postponements, refunds, and communications with participants.
- Obtaining all permits, licenses, releases, waivers, insurance, consents, and approvals required by law or contract.
- Having sufficient rights and permissions to upload flyers, logos, photographs, names, contact details, trademarks, and other content, including personal information belonging to third parties.
- Promptly correcting or removing inaccurate, outdated, cancelled, infringing, unsafe, or misleading information.
We may edit formatting, request corrections, hide, reject, suspend, or remove any profile or listing that we reasonably believe is inaccurate, misleading, unlawful, infringing, unsafe, duplicative, inappropriate, or inconsistent with these Terms. Our review or publication of a listing does not transfer responsibility for it to us.
Content Review and Moderation. New producer profiles, producer-page claims, low-confidence flyer imports, and recurring listings may be held for manual review before publication. Routine listings submitted by established producers may publish immediately but are subject to a database-enforced text filter covering titles, descriptions, venue fields, and event notes. The filter may block or hold clearly prohibited sexually explicit, hateful, threatening, or unlawful terms. Automated image-safety screening is not currently enabled.
Users may report an event, flyer, or producer profile through the in-app and website "Report it" controls, which direct the report to info@thejackpotguide.com. We may unpublish individual listings, restrict an account and hide its public listings, require future content to undergo review, or delete an account and associated content. We maintain an internal moderation procedure for triage, escalation, recordkeeping, appeals, and repeat-offender enforcement.
6. Producer subscriptions, payments, and add-ons
Certain producer tools require a paid subscription. We offer a single Producer Membership, billed either at $99 per month or $990 per year (equivalent to 2 months free). The membership does not include a free trial; your first charge occurs on the date of purchase, and the subscription automatically renews at the end of each billing period until cancelled.
All subscriptions are sold by The Jackpot Guide and processed through Stripe, including subscriptions initiated inside the mobile app through a Stripe web checkout opened in an in-app browser. Stripe collects payment information and may perform automated fraud screening through Stripe Radar. We do not receive or store full payment-card numbers.
You may cancel online at any time through the "Manage or Cancel Subscription" control in your producer account, which opens the Stripe customer portal. Cancellation prevents future renewal charges, and paid access ordinarily continues through the end of the current billing period. If you subscribe and have not used the membership, you may request a refund as described in our Refund Policy; except as provided there or where required by law, payments are non-refundable.
The membership may offer optional one-time add-ons. Featured placement currently costs $49 per event and runs up to 30 days through the end of that event. Other add-ons may be offered from time to time. The applicable price, scope, and duration of each add-on will be disclosed before purchase. An add-on does not automatically renew unless the checkout expressly states otherwise and obtains separate consent.
Complimentary, promotional, or discounted accounts may be offered at our discretion and may be modified or discontinued subject to applicable law and any written terms provided with the offer.
We may change subscription prices, plan features, and add-on offerings. Any increase to the recurring fee for an existing subscription will be communicated in advance as required by applicable law. Additional details are contained in the Automatic Renewal and Subscription Terms.
7. User content and license
You retain ownership of original content you submit, including flyers, logos, event details, business information, and other materials ("User Content"). You are responsible for User Content and for ensuring that you have all rights, licenses, permissions, releases, and consents necessary to submit and use it through the Service.
By submitting User Content, you grant The Jackpot Guide a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, copy, format, resize, crop, adapt, extract information from, create thumbnails and previews of, display, distribute, transmit, publish, and use the User Content as reasonably necessary to operate, improve, secure, market, and promote the Service and the events or producer profiles to which the content relates.
This license includes use within the website, mobile app, search results, maps, notifications, email, social-media promotions, advertisements for the Service, and internal administrative tools. It continues while the User Content remains in the Service and for a reasonable period in backups, logs, legal records, or previously created promotional materials, subject to the Privacy Policy and applicable law.
A subscription lapse may cause producer listings to be hidden rather than deleted so they can be restored if the producer resubscribes. Account deletion is handled as described in the Privacy Policy.
Content Concerning Minors. Producer content may include youth events, youth divisions, photographs, results, and other information concerning minors. You may not submit, publish, or authorize us to process personal information concerning a minor unless you have all permissions, releases, and consents required by law, including permission from the minor's parent or legal guardian where applicable. You must not publish a minor's private telephone number, personal email address, precise home address, school schedule, account credentials, government identifier, medical information, or other unnecessary sensitive information. We may remove content concerning a minor, restrict the submitting account, or request proof of authorization at any time.
Copyright Complaints and Repeat Infringers. We respond to notices of claimed copyright infringement under our DMCA Copyright Policy, which is incorporated into these Terms by reference. We may remove or disable access to material claimed to be infringing, forward and process counter-notifications, preserve related records, and suspend or terminate the accounts of repeat infringers. 8. Automated flyer and logo processing
The Service may use automated tools, including Anthropic's commercial artificial-intelligence API, to read event flyers, extract proposed event details, or analyze a producer logo. Automated results may be incomplete or inaccurate and must be reviewed and corrected by the producer before publication.
Do not upload unnecessary sensitive information. If a flyer contains a third party's name, phone number, email address, image, or other personal information, you represent that you are authorized to publish and process that information for the event listing.
9. Advertising and sponsored content
The Jackpot Guide sells and manages advertising and sponsored placements directly. We may select advertisements based on first-party information such as the discipline, event category, producer, or general geographic area being viewed within the Service.
Advertisers receive aggregate campaign reporting, such as total impressions, total clicks, and click-through rate. We do not provide advertisers with individual user identities, personal contact information, individual click histories, device identifiers, or internet protocol addresses for their independent marketing.
Advertisements and sponsored placements are supplied by or for advertisers. Their appearance does not constitute our endorsement or guarantee of the advertiser, product, service, event, or claim.
External Links and Advertisements. Advertisements, sponsored placements, and producer-supplied links must relate to lawful, age-appropriate rodeo, equine, event, agricultural, or business content and must not direct users to sexually explicit content, illegal gambling, unlawful products or services, hate or extremist content, dangerous or deceptive material, or other content inappropriate for a general-audience service available to users age thirteen (13) and older. We may reject, remove, disable, or require changes to any advertisement or external link at any time.
Producer-supplied external links are reviewed during producer approval. If an approved producer changes a website or social-media link, the changed link may be withheld from public display until an administrator approves it. External links lead to third-party services that The Jackpot Guide does not control.
10. Prohibited conduct
You may not, directly or indirectly:
- Use the Service for unlawful, fraudulent, deceptive, abusive, threatening, harassing, exploitative, or harmful conduct.
- Post false, misleading, defamatory, infringing, unsafe, obscene, or unauthorized content or personal information.
- Impersonate another person, business, producer, organizer, or representative, or misrepresent your affiliation or authority.
- Scrape, crawl, harvest, copy, download, index, aggregate, or extract data from the Service by automated means without our prior written permission.
- Use Service data, listings, producer information, or contact details to build or train a competing database, directory, model, product, or service, or to send spam or unsolicited communications.
- Reverse engineer, decompile, disassemble, copy, modify, or attempt to discover the source code, algorithms, nonpublic APIs, or security mechanisms of the Service, except where such restriction is prohibited by law.
- Circumvent access controls, subscription restrictions, rate limits, security features, or technological protections.
- Upload malware, malicious code, corrupted files, or content intended to disrupt, damage, monitor, or gain unauthorized access to systems or data.
- Manipulate or falsify impressions, clicks, saves, follows, RSVPs, reviews, engagement metrics, subscription records, or payment activity.
- Interfere with the operation, performance, availability, integrity, or security of the Service or another user's account.
11. The Jackpot Guide intellectual property
Except for User Content and third-party materials, the Service and all related intellectual property are owned by or licensed to The Jackpot Guide, LLC. This includes the name, logos, trademarks, service marks, software, source code, object code, databases, compilations, taxonomies, layout, user interface, visual design, workflows, proprietary tools, Flyer Tool, Flyer Builder, documentation, original text and graphics, analytics, trade secrets, and goodwill.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for its intended purposes. No other right or license is granted by implication, estoppel, or otherwise.
Facts concerning public events may not themselves be owned by us, but our software, selection, coordination, arrangement, presentation, database structure, original content, and other protectable elements remain our property.
12. Third-party services and links
The Service relies on or links to third-party services, including Stripe, Supabase, Vercel, Google Maps and Places, Resend, Expo, Apple Push Notification service, Anthropic, and external producer or sponsor websites. Third-party services are governed by their own terms and privacy practices.
We do not control and are not responsible for third-party websites, platforms, products, services, availability, security, content, or transactions. A link or integration does not imply endorsement.
13. SMS and electronic communications
By using the Service, you consent to receive transactional and administrative communications electronically, including account, security, subscription, billing, cancellation, and policy notices by email, in-app message, or other electronic means.
SMS alerts are an optional future feature and are not currently active. If you voluntarily provide a mobile number and give advance SMS consent, we may retain that consent and number so alerts can begin after the program is activated. No SMS messages will be sent until the feature is activated. Additional terms are contained in the SMS Terms and Conditions.
14. Suspension, cancellation, termination, and account deletion
You may stop using the Service at any time. Cancelling a subscription stops future renewals but does not automatically delete your account. When a paid producer subscription ends, listings may be hidden and retained so they can be restored upon resubscription.
You may request or initiate account deletion through the available account controls. Account deletion and data retention are governed by the Privacy Policy and may be subject to legal, tax, accounting, fraud-prevention, backup, dispute, and security retention requirements.
We may suspend, restrict, hide, or terminate an account, listing, subscription, or access to the Service when we reasonably believe that a user has violated these Terms, failed to pay, created legal or security risk, harmed users or third parties, abused the Service, or engaged in conduct inconsistent with the Service's intended purpose.
Where reasonable, we may provide notice and an opportunity to correct a violation, but we are not required to do so when immediate action is necessary for safety, security, legal compliance, fraud prevention, or protection of the Service or others.
15. Event, equine, travel, and participation disclaimers
RODEO, EQUINE, LIVESTOCK, ATHLETIC, AND TRAVEL ACTIVITIES INVOLVE INHERENT AND POTENTIALLY SERIOUS RISKS, INCLUDING PERSONAL INJURY, DEATH, ANIMAL INJURY OR DEATH, PROPERTY DAMAGE, WEATHER EXPOSURE, TRANSPORTATION RISK, AND FINANCIAL LOSS.
The Jackpot Guide does not organize, supervise, sanction, insure, inspect, or control listed events, venues, arenas, grounds, livestock, equipment, contestants, spectators, producers, contractors, safety practices, waivers, entries, payouts, or refunds. You assume responsibility for evaluating and accepting the risks of travel, attendance, entry, participation, and animal handling and for obtaining appropriate information, training, insurance, equipment, and professional advice.
16. General disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, SECURITY, OR RESULTS.
We do not warrant that the Service will be uninterrupted, error-free, complete, current, secure, or free from harmful components, or that listings, automated extraction, maps, directions, notifications, availability, prices, or third-party information will be accurate or timely.
Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
17. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE JACKPOT GUIDE, LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST PROFITS, REVENUE, BUSINESS, GOODWILL, OPPORTUNITIES, OR DATA; OR DAMAGES ARISING FROM EVENTS, TRAVEL, PERSONAL INJURY, ANIMAL INJURY, PROPERTY DAMAGE, CANCELLATIONS, PAYOUTS, REFUNDS, LISTING ERRORS, THIRD-PARTY CONDUCT, OR UNAUTHORIZED ACCOUNT ACCESS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO THE JACKPOT GUIDE DURING THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).
The limitations in this section do not apply to liability that cannot lawfully be excluded or limited. Some jurisdictions do not permit certain limitations, so portions of this section may not apply to you.
18. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless The Jackpot Guide, LLC and its members, managers, employees, contractors, agents, and service providers from and against claims, demands, proceedings, losses, liabilities, damages, judgments, penalties, costs, and reasonable attorneys' fees arising out of or relating to:
- Your access to or use of the Service.
- Your User Content, producer profile, event, listing, advertisement, promotion, or communications.
- The organization, operation, safety, cancellation, refund, payout, or conduct of an event you own, manage, promote, or list.
- Personal injury, death, animal injury, property loss, or other harm associated with your event or conduct.
- Your breach of these Terms, violation of law, or infringement of another person's intellectual-property, privacy, publicity, contractual, or other rights.
We may control the defense and settlement of an indemnified matter with counsel of our choosing. You agree to cooperate and may not settle a claim in a manner that admits fault by or imposes obligations on an indemnified party without our prior written consent.
19. Governing law and venue
These Terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law principles. Subject to any non-waivable consumer right or law requiring another forum, exclusive venue for any dispute arising from or relating to these Terms or the Service shall lie in the state or federal courts serving Caddo County, Oklahoma, and each party consents to personal jurisdiction in those courts.
20. Changes to the Service and Terms
We may modify, suspend, or discontinue all or part of the Service, plans, tools, or features from time to time. If a change materially affects an existing paid subscription, we will provide notice as required by applicable law.
We may revise these Terms. The Effective Date above identifies the current version. Material changes will be communicated through the Service, by email, or by another reasonable method when required. Continued use after revised Terms take effect constitutes acceptance, except where affirmative consent is required by law.
21. General provisions
Entire agreement. These Terms and the incorporated policies constitute the entire agreement between you and The Jackpot Guide concerning the Service and supersede prior understandings on that subject.
Severability. If any provision is invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain effective.
No waiver. Failure to enforce a provision is not a waiver of the right to enforce it later. A waiver must be in writing and signed by an authorized representative of The Jackpot Guide.
Assignment. You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms in connection with a merger, reorganization, financing, sale of assets, transfer of the Service, or operation of law.
No agency. These Terms do not create a partnership, joint venture, employment, fiduciary, franchise, or agency relationship between you and The Jackpot Guide.
Force majeure. We are not responsible for delay or failure caused by events beyond our reasonable control, including natural disasters, severe weather, fire, epidemic, labor disruption, utility or internet failure, cyberattack, governmental action, platform outage, or third-party service failure.
Survival. Provisions that by their nature should survive termination will survive, including intellectual property, licenses reasonably required for retained content, disclaimers, limitations of liability, indemnification, governing law, and general provisions.
Headings. Headings are for convenience only and do not limit the meaning of these Terms.
